Fair Use Policy

TalkNyx offers unlimited calling and texting on our flat-rate plans so you can run your business without watching a meter. “Unlimited” is designed for normal, fair and reasonable business use. This Fair Use Policy explains what that means, how usage beyond fair use is handled, and the practices that are never allowed. It works alongside our Terms & Conditions.
1. What “unlimited” means
Flat plans (Individual, Team and Business) include unlimited calling and texting for typical business communication — reaching your customers, teammates and vendors. We may review and, where necessary, limit usage that is not consistent with normal, fair and reasonable use, or that is better suited to our Pay-as-you-go plan. We look at overall patterns, including total minutes, total messages, call volumes and the number of devices in use.
2. Fair use allowance & overage
- Monthly fair-use allowance. Each flat plan includes a monthly fair-use allowance that comfortably covers normal business calling and texting.
- Beyond fair use. If usage on a flat plan goes well beyond that allowance, additional usage is simply billed at our standard Pay-as-you-go rates. We don’t cut off your service for going over — you keep calling and texting.
- High-volume use. If your business consistently runs high volumes (for example, call centers or bulk-messaging operations), the Pay-as-you-go plan is the right fit and we’ll help you move to it.
3. Rules for messaging
To keep messaging deliverable and compliant for everyone, you may not use TalkNyx to send:
- Spam or unsolicited bulk messages, or messages to recipients who have not consented to be contacted;
- Content that is unlawful, fraudulent, deceptive, obscene, harassing or threatening;
- Malware, phishing, or links intended to deceive or harm;
- Promotion of restricted or high-risk categories where prohibited (including cannabis, prescription drugs, gambling, firearms, alcohol and tobacco);
- Traffic that violates carrier rules, 10DLC / A2P registration requirements, the TCPA, or other messaging and telemarketing laws.
4. Rules for calling
You may not use TalkNyx calling to engage in:
- Traffic pumping or artificially inflated / revenue-share traffic;
- Auto-dialing, sequential dialing, or excessive very-short-duration calls;
- Repeated, unwanted or harassing calls;
- Caller-ID spoofing or misrepresenting the origin of a call;
- Robocalling or bot-driven calling that violates the TCPA or Do-Not-Call rules;
- Any use that violates applicable law or our carriers’ requirements.
5. Emergency calling (911)
Keep an accurate, dispatchable emergency (911) address on file for each number. See our Terms for the limitations of cloud-based emergency calling.
6. If usage isn’t fair
Where usage is inconsistent with this policy, we may — depending on the situation and with notice where practical — apply Pay-as-you-go overage rates, temporarily throttle or limit usage, ask you to move to a more suitable plan, or suspend or terminate the account for abuse or unlawful activity. Our goal is always to keep service running for legitimate business use.
